Steubenville Officials Launch Website - Business Insider

COLUMBUS, Ohio (AP) ? Authorities investigating rape accusations against two high school football players in eastern Ohio launched a website Saturday as interest in the case balloons, an extraordinary step designed to combat the misperception "that the football team runs the city," the city manager said.

Two 16-year-old boys are set for trial next month in juvenile court in Steubenville, a town of about 18,000, on charges that they raped a 16-year-old girl in August. Their attorneys have denied the charges in court.

Public interest in the case increased with circulation online this week of an unverified video, more than 12 minutes long, that purportedly shows another young man joking about the accuser. The video apparently was released by hackers who allege more people were involved and should be held accountable.

One aim of the website, City Manager Cathy Davison said, is to combat a common perception that Steubenville High School ? home of the "Big Red" sports program ? controls politics in a small city where special prosecutors and a visiting judge are handling the case because local authorities knew people involved with the football team.

"When people are saying that our police department did not follow procedure, that the football team runs the city, that is not the case," Davison said. "They went by the book. Everything was handled in an above-board fashion to make sure that the case can benefit from the fullest extent of the law."

Intended to sort fact from fiction, the website has the appearance of a legal briefing, with black type on a white background, providing an intentional departure from escalating emotions over the case and how it's been handled. It provides a timeline of the case, summaries of Ohio laws that affect sex charges, online posts and reaction to them and a pledge of transparency.

"It looks very generic, but it was meant to be (that way), because it's just the facts. There's nothing flowery about it," said Davison.

The site, sponsored by Steubenville city and police officials, explains that only a handful of police officers attended local schools and that the city manager herself is not even from Ohio. Its launch followed the hiring of a consultant who's helping the city handle a barrage of media attention sparked by the case.

The site declares it "is not designed to be a forum for how the Juvenile Court ought to rule in this matter."

Steubenville sits in a region of the state that's benefited economically from a recent shale gas drilling boom, and Steubenville got a boost when it was selected as the site of Gov. John Kasich's 2012 State of the State address, the first held outside the Statehouse in recent memory.

"Steubenville is a fantastic place to live, work and play," said Davison. "We have warm and loving people here, and this incident could be anywhere in America or the country or the world, and it's really unfortunate that it's tarnishing the city's reputation."

As investigation continues, it has spurred heated commentary online. Some support the defendants and question the character of the teenage girl, while others allege a cover-up or contend more people should be charged.

The latter group includes hacker-activists associating under the Anonymous and KnightSec labels who point to comments they say were posted around the time of the alleged attack on social media by people who are not charged.

At a second peaceful protest at the local courthouse in as many weeks Saturday, protesters, some wearing masks, gave details of their own rapes or those of relatives. They lamented what they said was a laissez faire attitude to sexual crimes in the community.

NHL says 48-game regular season is 'most likely'

The NHL appears headed toward a 48-game season for the second time in two decades.

"I think 48 is most likely at this point, unless the players can expedite their ratification process," NHL deputy commissioner Bill Daly wrote in an email Monday to The Associated Press.

The NHL shortened its 82-game slate to 48 games during the 1994-95 season after a 103-day lockout. A 301-day lockout in 2004-05 made the NHL the first major North American professional sports league to lose an entire season.

When the framework of a new collective bargaining agreement was agreed to Sunday morning ? after 16 hours of negotiations ? there was some talk of having a 50-game season start later this month.

The NHL and the players' association are working on a memorandum of understanding, which could be completed soon then voted on by team owners and players. The league has circulated a memo to teams telling them to be ready to play by Jan. 19, the date the shortened season is expected to start.

"As we prepare for the season opener, I want to apologize to all Blues fans, especially our season ticket holders, suite holders, and sponsors," St. Louis Blues owner Tom Stillman said in a statement released by the team. "We share in your disappointment and frustration about the lockout."

Los Angeles Kings forward Kevin Westgarth, who was a part of the union negotiating team for much of the more than 100-day lockout, expects the NHLPA to conduct a conference call to explain and answer questions about the new CBA before players vote on it online.

"Of course the league will say if the players hurry up, we can play more games, but there's a reality to consider as well," Westgarth said in a telephone interview Monday from Raleigh, N.C., where he skated informally with some Carolina Hurricanes. "But the first step is for the people who are good with words to get on paper what both sides agreed to.

"Then, we have to get guys ? who are scattered all over the world ? to understand the agreement before we can start voting."

Some NHL players ? including Washington Capitals star Alex Ovechkin ? went overseas during the lockout. Ovechkin has been playing for his hometown Dynamo Moscow in the Kontinental Hockey League, but plans to be back in the United States soon.

"Alex is returning early this week," Ovechkin's IMG agent, David Abrutyn, told AP.

Players ? teammates and opponents ? who stayed in North America have been getting together for months to skate, conduct on-ice drills and work out on their own to stay in relatively good shape.

Pittsburgh Penguins star Sidney Crosby and nearly a dozen teammates worked out at a suburban Pittsburgh ice rink Monday.

For a change, Crosby and the rest of the NHL players knew games will be played after negotiators for both sides ? and an outside mediator ? found a way to revive a sport desperate to regain momentum and boost its prominence.

The league and its union agreed to the framework of a 10-year labor contract, ending a bitter dispute that wiped out a large part of the hockey season for the third time in less than two decades. On the 113th day of the lockout and five days before the league's deadline for a deal, the bleary-eyed sides held a 6 a.m. Sunday news conference to announce there would be a season after all.

The lockout could wipe out perhaps $1 billion in revenue this season because about 40 percent of the regular-season schedule won't be played.

The NHL's revenue of $3.3 billion last season lagged well behind the NFL ($9 billion), Major League Baseball ($7.5 billion) and the NBA ($5 billion). The new deal will lower the hockey players' percentage from 57 to 50 after owners originally had proposed the players get 46 percent.

This was the third lockout among the major U.S. sports in a period of just over a year. A four-month NFL lockout ended in July 2011 with the loss of only one exhibition game, and an NBA lockout caused each team's schedule to be cut from 82 games to 66 last season.

Activists wary as India rushes to justice after gang rape

NEW DELHI (Reuters) - It's no surprise the Indian street wants faster, harsher justice for sexual crimes after a horrific gang rape that rocked the nation, but some activists worry the government will trample fundamental rights in its rush to be in tune with popular rage.

Last month's rape of a physiotherapy student on a moving bus and her death on December 28 in hospital triggered a national debate about how to better protect women in India, where official data shows one rape is reported on average every 20 minutes.

Many women's rights groups are cautiously hopeful the protests and outrage that followed the crime can be channeled into real change - fast-track courts for sexual offences and a plan to hire 2,500 new women police in Delhi are measures already in the works.

But legal experts and some feminists are worried that calls to make rape punishable with death and other draconian penalties will cramp civil liberties and are unconstitutional. They say India needs better policing and prosecutions, not new laws.

"If there are not enough convictions, it is not because of an insufficiency of law, but it is the insufficiency of material to base the conviction on," said retired Delhi High Court judge R.S. Sodhi.

Five men have been charged with the student's rape and murder and will appear before a New Delhi court later on Monday. They are due to be tried in a newly formed fast-track court in the next few weeks. A teenager also accused will likely be tried in a juvenile court.

Ahead of Monday's court appearance the five still had no defense lawyers - despite extensive interrogations by the police, who have said they have recorded confessions - after members of the bar association in the South Delhi district where the case is being heard vowed not to represent them.

GROUNDS FOR APPEAL

The men will be assigned lawyers by the court before the trial begins, but their lack of representation so far could give grounds for appeal later should they be found guilty - similar cases have resulted in acquittals years after convictions.

"The accused has a right to a lawyer from point of arrest - the investigations are going on, statements being taken, it is totally illegal," said Colin Gonsalves, a senior Supreme Court advocate and director of Delhi's Human Rights Law Network.

Senior leaders of most states on Friday came out in support of a plan to lower to 16 the age that minors can be tried as adults - in response to fury that the maximum penalty the accused youth could face is three years detention.

A government panel is considering suggestions to make the death penalty mandatory for rape and introducing forms of chemical castration for the guilty. It is due to make its recommendations by January 23.

"The more you strengthen the powers of the state against the people, the more the possibility you create a draconian regime," said Sehjo Singh, Programme and Policy Director with ActionAid in India and an expert on Indian women's social movements.

"We want to raise the bar of human rights in India, we want to raise the standards, not lower them."

The Indian Express newspaper warned against "knee-jerk" reaction and said any change to the juvenile law "must come after rigorous and considered debate. It cannot be a reaction to a fraught moment".

Courts are swamped with a backlog of cases in the country of 1.2 billion people and trials often take more than five years to complete, so the launch by Chief Justice Altamas Kabir of six fast-track courts in the capital to deal with sexual offences was widely greeted as a welcome move.

Several other states including Tamil Nadu and Maharashtra are now looking at following Delhi's example.

But Gonsalves says while the courts are a good idea on paper, similar tribunals in the past delivered dubious verdicts and put financial pressure on the rest of the justice system.

FAST TRACK COURTS

India set up 1,700 fast-track courts in 2004, but stopped funding them last year because they turned out to be costly. The courts typically work six days a week and try to reduce adjournments that lead to long delays in cases.

"The record of the fast-track courts is mixed," Gonsalves said. Conviction rates rose, he said, but due process was sometimes rushed, leading to convictions being overturned.

"Fast-track courts were in many ways were fast-track injustice," he said.

The real problem lie with bad policing and a shortage of judges, Gonsalves said. India has about a fifth of the number of judges per capita that the United States has.

Indian police are often poorly trained and underpaid, and have sometimes been implicated in organized crime. Rights groups complain the mostly male officers are insensitive to victims of sexual crimes.

Resources for, and expertise in, forensic science is limited in most of the country's police forces and confessions are often extracted under duress. The judiciary complains it is hard to convict offenders because of faulty evidence.

Human Rights Watch said reforms to laws and procedures covering rape and other sexual crimes should focus on protection of witnesses and modernizing support for victims at police stations and hospitals.

The rights organization has documented the continued use of archaic practices such as the "finger test" used by some doctors on rape victims to allegedly determine if they had regular sex.

"Reforms in the rape laws - these are needed. But not in terms of enhancing punishment," said Meenakshi Ganguly, South Asia Director of Human Rights Watch.

"Why they are not investigated, why there are not enough convictions, those are the things that need to be addressed."
